Diversity in Delaware

Queer Community of DE

The LGBTQ+ community in Delaware is currently the focus of a significant historical and cultural project. The Division of Historical and Cultural Affairs has initiated "Delaware’s LGBTQ+ Community: A Research & Digital Engagement Project," aiming to be a comprehensive effort to document and share the community's
history within the state. The project will include an online digital platform to present collected stories, photographs, and other cultural artifacts, aiming to provide a resource that reflects the diverse and often underrepresented histories of LGBTQ+ Delawareans.

The LGBTQ+ community in Delaware enjoys legal protections and rights that have evolved significantly over time. Same-sex sexual activity has been legal since 1973, and the state has recognized civil unions since 2012, which paved the way for legalizing same-sex marriage in 2013 . Discrimination based on sexual orientation and gender identity is prohibited in employment, housing, and other areas, with laws in place since 2009 and 2013, respectively . Additionally, hate crime legislation in Delaware has been inclusive of sexual orientation since 2001 and gender identity since 2013 .

In terms of family rights, same-sex couples have been able to adopt since at least 2001, and they have the same adoption rights as opposite-sex couples following the legalization of civil unions and same-sex marriage . In 2023, Delaware made further strides by passing a bill to repeal the "gay and trans panic defense," reflecting the state's ongoing commitment to LGBTQ+ rights .

For a more comprehensive look at the experiences and contributions of the LGBTQ+ community in Delaware, additional sources and perspectives would be beneficial, including local community organizations, historical accounts, and current events impacting the community.
